By signing up for Zaapi services, you are agreeing to be bound by the following Terms and Conditions of Service. Any new features or tools which are added to Zaapi shall be also subject to the Terms and Conditions of Service. Those can be reviewed at any time here and shall be checked from time to time for any updates or changes that may impact you.

You must read, agree with, and accept all of the terms and conditions contained in this Terms and Conditions of Service agreement and Privacy Policy before becoming a Zaapi user.

Account terms

  1. You must be 18 years or older or at least the age of majority in the jurisdiction where you reside or from which you use this Service.
  2. You acknowledge that Zaapi will use the email address you provide as the primary method for communication.
  3. You are responsible for keeping your password secure.
  4. You are responsible for all activity and content such as data, and photos that are uploaded under your Zaapi store. You must not transmit any viruses or any code of a destructive nature.
  5. A breach or violation of any term in the Terms and Conditions of Service will result in an immediate termination of your services with Zaapi.

Account activation

  1. The person signing up for Zaapi’s services will be the contracting party (“Account Owner”) for the purposes of our Terms and Conditions of Service and will be the person who is authorized to use any corresponding account we may provide to the Account Owner in connection with Zaapi’s services.
  2. You are responsible for granting access to the account only to authorized representatives.
  3. Upon completion of sign up for Zaapi’s services, you acknowledge that Zaapi will retrieve necessary information from Facebook and/or LINE and other platforms on your behalf. You are solely responsible for such actions. Do not create an account or retrieve information if it will violate any laws in your jurisdiction.
  4. Package purchasing or package upgrade is per account basis unless stated otherwise in promotional materials.

General conditions

You must read, agree with, and accept all of the Terms and Conditions of Service contained here and the Privacy Policy before you may become a member of Zaapi.

  1. You may not use Zaapi’s services for any illegal or unauthorized purpose nor may you, in the use of Zaapi, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of the Kingdom of Thailand.
  2. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of Zaapi without the express written permission by Zaapi.
  3. You acknowledge and agree that your use of Zaapi’s services, including information transmitted to or stored by Zaapi, is governed by its privacy policy.

Zaapi’s rights

  1. We reserve the right to modify or terminate Zaapi’s services for any reason, without notice at any time.
  2. We reserve the right to refuse service to anyone for any reason at any time.
  3. We may, but have no obligation to, remove Store Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violate any party’s intellectual property or these Terms and Conditions of Service.
  4. Verbal or written abuse of any kind (including threats of abuse or retribution) of any customer, Zaapi employee, member, or officer will result in immediate account termination and support suspension.
  5. Zaapi shall not be responsible for any information provided by merchants and its customers. It is in their sole discretion to refuse or remove any Store Content that is available via the Service.
  6. In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm account ownership. Documentation may include but is not limited to, a scanned copy of your business license, government-issued photo ID, the last four digits of the credit card on file, etc.
  7. Zaapi retains the right to determine, in our sole judgment, rightful account ownership and transfer an account to the rightful owner. If we are unable to reasonably determine the rightful Account owner, Zaapi reserves the right to temporarily disable an Account until resolution has been determined between the disputing parties.

Limitation of liability

  1. You expressly understand and agree that Zaapi shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the service.
  2. Your use of Zaapi’s services is at your sole risk. Zaapi’s services are provided on an ”as is“ and ”as available“ basis without any warranty or condition, express implied, or statutory.
  3. Zaapi does not warrant that Zaapi’s services will be uninterrupted, timely, secure, or error-free.
  4. Zaapi does not warrant that the results that may be obtained from the use of Zaapi’s services will be accurate or reliable.
  5. Zaapi does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through Zaapi’s services will meet your expectations, or that any errors in the Service will be corrected.

Intellectual property and customer content

  1. We do not claim any intellectual property rights over the material you provide to Zaapi. All material you upload remains yours. You can remove your information at any time by deleting your account. This will also remove all content you have stored on the Service.
  2. By uploading Store Content, you agree: (a) to allow other internet users to view your Store Content but not your backend dashboard and private information; (b) to allow Zaapi to display and store your Store Content; and (c) that Zaapi can, at any time, review all the Store Content submitted by you to its Service.
  3. You retain ownership over all Store Content that you upload and import to a Zaapi store; however, by posting public comments or upload public information you agree to allow others to view your content. You are responsible for compliance of content with any applicable laws or regulations.

Cancellation and termination

  1. You may cancel your account at any time by emailing — and then following the specific instructions indicated to you in Zaapi’s response.
  2. We reserve the right to modify or terminate the Zaapi service for any reason, without notice at any time.
  3. Fraud: Without limiting any other remedies, Zaapi may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site or any part of Zaapi’s services.

Modifications to the services and prices

  1. Prices for using Zaapi are subject to change upon reasonable notice from Zaapi. Such notice may be provided at any time by posting the changes to the Zaapi website.

Payment processing services

Zaapi does not currently provide any payment processing services and any and all transactions conducted using the Zaapi platform must be arranged separately by the merchant and buyer.

Prohibited and Restricted Items policy

The Seller’s responsibility is to ensure that their item complies with all laws and is allowed to be listed for sale per Zaapi terms and policies. They must do this before listing the item on the selling platform. For the Sellers’ convenience, Zaapi has provided below a non-exhaustive guideline on prohibited and restricted items that are not allowed for sale on this platform.

1. LIST OF PROHIBITED AND RESTRICTED ITEMS

  1. Animal and wildlife products (including, without limitation, wild animals)
  2. Artifacts and antiquities;
  3. Used cosmetics;
  4. Counterfeit currency and stamps;
  5. Credit and debit cards;
  6. Currency or credits including, without limitation, digital currency or credits, and stored value cards;
  7. Drugs, prescription-only medicines, pharmacy-only medicines, drug-like substances, and associated paraphernalia.
  8. Telecommunication equipment that has not been registered with the Malaysian Communications and Multimedia Commission (MCMC), and electronic surveillance equipment and other similar electronic equipment such as cable TV, de-scramblers, radar scanners, traffic signal control devices, wiretapping devices, and telephone bugging devices;
  9. Embargoed goods;
  10. Firearms, weapons such as pepper spray, replicas, and stun guns, etc.;
  11. Alcohol (a valid license must be submitted to, and approved by, Shopee);
  12. Prohibited Food: For the safety of our Users, Sellers may not list the following food and food-related items on our Site:
  13. ~Listings containing medicinal claims: that is, a claim that the item is intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans and/or animals, contraception, inducing anesthesia, or otherwise preventing or interfering with the regular operation of a physiological function, whether permanently or temporarily, and whether by way of terminating, reducing or postponing, or increasing or accelerating, the operation of that function or in any other way (for example, pharmaceutical drugs, contact lenses, misbranded dietary supplements);
  14. ~Noxious food items: Food which contains any prohibited substances or substances over permitted amounts, adulterated food without fully informing Buyer at the time of sale of the nature of the transaction;
  15. ~Non-pasteurised dairy products;
  16. ~Wild mushrooms; and
  17. ~Any other food items hazardous to human health.
  18. Food not falling into the Prohibited Food category above must adhere to these minimum standards and guidelines:
  19. ~Expiration dates – all food items must be clearly and correctly labelled with an expiration or “use by” date. Expired food items must not be listed.
  20. ~Sealed containers – all food and related products sold on the Site should be packaged or sealed to ensure that Buyer can identify evidence of tampering or defect; and
  21. ~Perishable food items – Sellers who list perishable items should clearly identify in the item description the steps that they will take to ensure that the goods are appropriately packaged.
  22. Government or Police related items such as badges, insignia, or uniforms
  23. Human parts or remains
  24. Lock-picking devices
  25. Lottery tickets
  26. Pesticides
  27. Potentially infringing items: Items including but not limited to replicas, counterfeit items, and unauthorized copies of a product that may violate copyrights, trademarks, or other intellectual property rights of third parties.
  28. Services: Unless expressly allowed by Shopee, the provision of services, including but not limited to services that are sexual, illegal in nature, or violate the Terms of Service, are prohibited on the platform.

  32. Tobacco or tobacco-related products, including without limitation electric cigarettes/e-juices that contain nicotine;
  33. Obscene, seditious or treasonous materials
  34. Products that (a) relate to political issues or public debate, (b) advocate for or against a politician or political party, or (c) promote any form of hate, crime, prejudice, or violence;
  35. Publications, books, films, videos, and/or video games that do not comply with applicable laws in the country of sale and/or delivery
  36. Stolen goods
  37. Mislabelled goods
  38. Any items that are or contain components that are (i) illegal or restricted in the jurisdiction of the Buyer and/or the Seller or (ii) encourage illegal or restricted activities, or
  39. pose a potential health or safety risk.

2. VIOLATION OF OUR TERMS OF SERVICE

Violations of this Prohibited and Restricted Items Policy may subject the Seller to adverse actions, including but not limited to:

  1. Listing deletion
  2. Limits placed on account privileges
  3. Account suspension and termination
  4. Legal actions
